By the present writ petition the petitioner seeks direction upon the respondents to disburse the interest amounts towards arrear pension from the date following the date of superannuation till the date of actual payment along with interest at the rate of 18% per annum. 3. The petitioner contends that her husband, namely, late Bahadur Sing was a Primary Teacher of Majura Primary School under Rohini Circle in the district of Jhargram, who retired on 31st August, 2012 on superannuation and died on 13th September, 2024. The Pension Payment Order was issued in favour of the petitioner’s husband on 24th December, 2013. The gratuity and arrear pension was disbursed on 12th February, 2014. However, no interest on delayed payment was paid to the petitioner’s husband. Hence this writ petition. 4. Mr. Debasis Dey, learned advocate for the petitioner submits that the petitioner is entitled to the interest on delayed payment of gratuity and arrear pension. 5. Despite service, none appears on behalf of the State. 6. Mr. Nazar Chowdhury, learned advocate, who usually appears for the State, is requested to appear in this matter. Let his appointment be regularised by the concerned authority. 7. The petitioner is directed to hand over a copy of the writ petition along with the annexures to Mr. Chowdhury, learned advocate for the State. 8. Mr. Chowdhury, learned advocate for the State does not raise any objection and leaves the matter to the discretion of the Court. 9. In view of the contentions raised in the writ petition, respondent no. 2, the Director of Pension, Provident Fund and Group Insurance, Government of West Bengal and respondent no. 4-Treasury Officer, Jhargram, P.O. & P.S. Jhargram, Dist. Jhargram are directed to pay the interest at the rate of interest @ 8% per annum on the gratuity and arrear of pension in favour of the petitioner by way of the pensionary benefits from the date following the date of superannuation of petitioner’s husband till the date of 2 actual payment within a period of eight weeks from date of communication of this order. 10. Learned advocate for the petitioner is directed to communicate this order to respondent no. 2, the Director of Pension, Provident Fund and Group Insurance, Government of West Bengal and respondent no. 4-Treasury Officer, Jhargram, P.O. & P.S. Jhargram, Dist. Jhargram for necessary compliance. 11. With the aforesaid directions, the writ petition being WPA 17979 of 2025 stands disposed of. 12. Since no affidavit is called for, the allegations made in the writ petition are deemed to have been denied. 13. Consequently, connected applications, if any, stand disposed of. 14. Interim order, if any, stands vacated. 15. There shall be no order as to costs. 16.
