Nos.2441 of 2018 AND 512 of 2019 The Court made the following: ADVANCE COMMON ORDER : (Per Hon’ble Sri Justice K.Suresh Reddy) In the result, both the Criminal Appeals are allowed in part by setting aside the conviction and sentence recorded against the appellants/A.1 and A.2 by the learned XIII Additional District and Sessions Judge (FTC), Vijayawada in S.C. No.96 of 2018, dated 10.05.2018, for the offence under Section 302 IPC. Instead, the appellants/A.1 and A.2 are convicted for the offence under Section 304 Part II IPC and sentenced them to the period already undergone by them while maintaining the fine amount, as both the accused have already undergone more than eight (08) years of imprisonment. Insofar as the conviction and sentence recorded against the appellants/A.1 and A.2 for the offence under Section 201 IPC is concerned, the same is confirmed and remain unaltered including the fine amount. 2. As the appellant/A.1 in Crl.A. No.2441 of 2018 has already undergone the entire sentence, including the default sentence, he shall be set at liberty forthwith, if he is not required in connection with any other case or crime. 3. As the appellant/A.2 in Crl.A. No.512 of 2019 was already released on bail by order of this Court vide I.A.No.1 of 2025, dated 11.02.2025, in terms of the order, dated 02.11.2016, passed by the 4 Crl.A. Nos.2441 of 2018 AND 512 of 2019 Combined High Court in Batchu Rangarao and others Vs The State of Andhra Pradesh (Crl.A.M.P.No.1687 of 2016 in Crl.A.No.607 of 2011), her bail bonds shall stand cancelled.
