Learned counsel for the parties submit that the matters have been settled out of court between the parties in terms of the compromise 2 recorded at paragraph no. 6 of CAN 4 of 2026 and CAN 3 of 2026 filed in connections with the appeals respectively, which are as follows: 6. “i) The plaintiff/appellant has agreed to purchase the ½ portion of the undivided suit property and the defendant/respondent has consented to such proposal. ii) During the pendency of the appeal between the appellant and the respondent, a registered agreement for sale was executed pertaining to purchase of the ½ undivided portion of the disputed said property involved in the first appeal. iii) Thereafter the appellant will withdraw the First Appeal as the disputes involved in it have been compromised”. 2. Accordingly, FA No. 115 of 2025 and FAT No. 45 of 2025 are disposed of in terms of the above compromise arrived at between the parties. The above terms be made a part of the decree. 3. CAN 4 of 2026 filed in connection with FA No. 115 of 2025 and CAN 3 of 2026 filed in connection with FAT No. 45 of 2025 are disposed of accordingly. 4. Formal decrees be drawn up in each of the appeals. 5. There will be no order as to costs. (Sabyasachi Bhattacharyya, J.) I agree. (Sandip Kumar De, J.)
