Affidavit of service filed in Court is taken on record. 2. Complaining illegal construction at the petitioner’s plot situated at Mouza – Palpara, of R.S. & L.R. plot no. 153, R.S. Khatian No. 848 L. R. Khatian No. 845 and 847 of 35 no. Palpara Mouza under Chakdaha Municipality, which the petitioner has purchased in the year 2011 by a registered sale deed, the instant writ petition has been filed. 3. Having heard the learned advocates appearing for the respective parties and though the person who has constructed upon the petitioner’s property has not been made party, however, I am of the view noting the case of illegal construction made out, the municipality ought to have enquired into the matter. 4. In view thereof, I direct the municipality to carry out an inspection at the locale upon providing an 2 WPA 23775 of 2026 opportunity of hearing to all the interested parties and to take a decision in the matter by passing a reasoned order in accordance with law. 5. With the above observations and directions, the writ petition is disposed of. 6. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with the requisite formalities. (Raja Basu Chowdhury, J.)
