25-09-2026 Item No.1 Subrata Bhattacharyya AR(C) IN THE HIGH COURT AT CALCUTTA Constitutional Writ Jurisdiction Appellate Side WPA No.10032 of 2026 Keshab Chandra Mandal -vs- The State of West Bengal & Ors. Mr. Sakti Pada Jana Mr. Subhajyoti Das …for the petitioner Ms. Mary Datta Ms. Sneha Chatterjee …for the State 1. The direction passed by the Court on July 24, 2026 directing the District Inspector of Schools (SE), South 24 Parganas to prepare and circulate a report by August 11, 2026 has not been complied with till date. The petitioner has retired from service on May 31, 2026 but his terminal dues cannot be disbursed on account of non- fixation of his pay. 2. From the documents annexed to the writ petition, it appears that the DI of Schools has forwarded the intimation relating to fixation of pay of the petitioner to the headmaster/president of the concerned school. 3. Learned counsel for the petitioner submits that the DI of Schools ought to take steps in terms of the fixation made vide Memo No.GA/345/2025 dated August 5, 2025. 4. As it appears that the DI has already fixed the pay of the petitioner, accordingly, the writ petition is disposed of by directing the respondents – both the school and the DI of Schools – to make the pension file of the petitioner ready by taking into consideration the fixation of pay made by the DI of Schools on August 5, 2026. The pension file of the petitioner shall be forward to the DPPG for issuance of PPO. Steps shall be taken in the matter at the earliest. 5. The DI of School shall ensure that the PPO is issued in favour of the petitioner and pension is disbursed positively by December 31, 2026. 6. The writ petition stands disposed of. 7. All parties are to act on the server copy of this order duly downloaded from the official website of this Court. 8. Certified server copy of this order, if applied for, shall be made available to the parties. [Amrita Sinha, J] 2 3
