1. Affidavit of service filed in the Court is taken on record. 2. The writ petitioner is the owner of the shop-room at the basement at premises No. 42, Maharaja Nanda Kumar Road (North), Kolkata – 700 035, Mouza & Municipality – Baranagar. His grievance is that in spite of repeated applications being made before the respondent-CESC authority, he has not been granted with commercial electricity connection over the said premises of him. Hence, this writ petition is filed seeking appropriate relief. 3. Parties are represented. 4. Mr. Mukherjee, learned advocate appearing for the CESC, has submitted that on repeated occasions, the respondent authority has visited the premises for the purpose of conducting inspection but failed due to
2 objection by the private respondents. He indicates that the respondent authority is ready and willing to provide electricity connection subject to compliance of all formalities by the petitioner concerned and subject to availability of police help, if necessary, at the time of installation of connection. 5. Having heard both the learned advocates for the respective parties and on perusing the documents on record, it appears that the first application of the petitioner for grant of commercial electricity connection was made on March 28, 2023. It appears that in spite of making endeavour, the respondent authority could not complete the inspection of the premises due to multifarious reasons including objection raised by the private respondents. Admittedly, therefore, in spite of being the owner of the concerned property as well as occupier thereof and having made an application for grant of commercial electricity connection, the petitioner is still deprived of such facility, which is in stark contradiction with the statutory right available to the petitioner. 6. In such circumstances, this Court finds it appropriate to dispose of the instant writ petition by directing the respondent CESC to immediately cause inspection over the concerned premises on September 30, 2026 at 12 noon in presence of the petitioner and the private respondent.
Upon being satisfied about compliance of
3 all necessary and legal formalities by the petitioner, it shall proceed in accordance with law for grant of commercial electricity connection to the said premises. 7. Let not any notice be separately served upon the parties by the respondent CESC as regards the date and time of inspection, in view of the order as above. 8. The respondent CESC authority shall take police help at the cost of the present petitioner, if necessary, at the time of inspection as well as installation of electricity line at the concerned premises. 9. The entire exercise as above should be concluded by the respondent authority within a period of six (06) weeks from date of inspection. 10. The writ petition is disposed of with the above direction. 11. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. 12. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance with all requisite formalities. (Rai Chattopadhyay, J.)
