This first bail application has been moved by the applicant seeking regular bail in F.I.R./Case Crime No.216 of 2025, under Sections 190, 191(2), 191(3), 103(1) and Section 238 of B.N.S., 2023, registered at Police Station Ramnagar, District Nainital. 3. Learned counsel for the applicant submits that applicant has falsely been implicated in the instant crime, has no criminal history and is languishing in jail since 16.06.2025. Learned counsel for the applicant submits that applicant is not named in the F.I.R. and nothing has been recovered from the possession or from pointing out of the applicant. It is contended by learned counsel for the applicant that co-accused, namely, Faijan has already been enlarged on bail by this Court in BA1 No.1721 of 2025 vide order dated 16.04.2026. He submits that this is a case of parity and in case, the applicant is granted bail, he will not misuse the same and will furnish the bail surety as per the satisfaction of this Court. 4. Learned State Counsel has vehemently opposed the prayer for bail. 5. Having regard to the fact that the 2026:UHC:3327 co-accused, namely, Faijan has already been enlarged on bail by this Court, and without expressing any opinion on the merits of the case, this Court is of the considered view that the present applicant is also entitled to be released on bail at this stage on the ground of parity. 6. The bail application is allowed. 7. Let the applicant, namely, Sharukh be released on bail, on executing personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Court concerned.
