JUSTICE SAMEER JAIN Order 17/04/2026 1. The matter comes up on applications (I.A. No. 3/2025 and I.A. No. 4/2025) filed on behalf of the respondents, seeking vacation of the interim order dated 11.06.2025 passed by this Court. 2. It is brought to the notice of this Court by the learned counsel for the respondents that the present proceedings constitute a second round of litigation inter se the parties. It is submitted that in the first round, vide order dated 05.05.2025, this Court had directed the respondent-authorities to decide the underlying dispute by passing a reasoned and speaking order, after affording a due opportunity of hearing to the concerned parties. 3. Subsequently, the present writ petition was instituted, and an interim order dated 11.06.2025 was passed in favour of the petitioners. The said interim protection was granted primarily on the premise that the impugned order passed by the authorities was highly cryptic, non-speaking, and suffered from a total non- application of mind. 4. Today, learned counsel appearing for the respondents has prayed that the matter may be remitted back to the Appellate [2026:RJ-JP:16228] (3 of 3) [CW-9223/2025] Authority with a specific direction to adjudicate the issue afresh. It is undertaken that the authority shall pass a detailed speaking order in accordance with the law, strictly after affording a due opportunity of personal hearing to the petitioners. 5. Learned counsel appearing for the petitioners has not refuted the aforesaid submission and has no objection to the same. 6. Accordingly, the Appellate Authority, i.e., Secretary, Department of Youth Affairs and Sports, Rajasthan, is directed to consider and decide the pending Appeal No. F.10(7) Sports/2005, afresh. 7. It is made clear that the Appellate Authority shall afford a due opportunity of personal hearing to all the concerned parties, ensuring strict compliance with the principles of natural justice and audi alteram partem. Following the said hearing, the authority shall adjudicate the matter and pass a reasoned and speaking order within a period of 60 days from the date of passing this order. 8. In view of the above terms, the present writ petition stands disposed of. The applications seeking vacation of the stay order (I.A. No. 3/2025 and I.A. No. 4/2025), along with any other pending application(s), shall also stand disposed of. 9. Registrar (Judicial) is directed to send a copy of the present order by fax/mail in the office of the Appellate Authority i.e., Secretary, Department of Youth Affairs and Sports, Rajasthan.
