Affidavit of service filed on behalf of the petitioner is taken on record. The respondents are not represented despite service. Learned counsel for the petitioner submits that pursuant to a work order issued by the Chairman, Mal Municipality in favour of the petitioner on 11th August, 2023 for supply and erection, installation and delivery of Sunway solar street lighting 15 WP Led based system, the petitioner supplied the required material and raised bills for the same. The Municipality was not satisfied with the quality of the material for which a letter was issued to the petitioner on 22nd March, 2024 requesting submission of work related documents. The required documents were submitted by the petitioner by a letter issued on 2nd April, 2024 pursuant to which physical verification of the material/work was held by
2 the authority on 13th May, 2024. The petitioner submitted a representation before the concerned authority on 22nd December, 2025 seeking disbursal of the dues. The representation is yet to be considered. The payment is also due till date. In view of the fact that the representation submitted by the petitioner is pending for long, the Chairman, Mal Municipality, being the 2nd respondent herein, is directed to consider and dispose of the same within four weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law. The decision taken by the authority shall be communicated to the petitioner within a week thereof. The concerned authority shall verify the genuineness of the claim of the petitioner made in the representation and in the event the authority arrives at a decision in favour of the petitioner, necessary consequential steps be taken at the earliest subject to the petitioner complying with all necessary formalities. The writ petition is disposed of. There shall be no order as to costs.
3 Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J)
