INDIRESH ORAL ORDER In this petition, the petitioner is challenging the order dated 17th January, 2024 (Annexure-G) passed by the respondent No.1-Deputy Commissioner in Revision Petition No.230/2018, wherein, the order dated 11th July, 2018 (Annexure-H) passed by the respondent No.2-Assistant - 3 - HC-KAR CNR: KAHC010080262024 NC: 2026:KHC:53176 WP NO.4946 OF 2024 Commissioner in Case No.R.A(DH):165/2017 came to be set- aside. 2. Heard Sri. P.N. Manmohan, learned counsel on behalf of Sri. Mudduraj C., appearing for the petitioner; Sri. Shamanth Naik, learned Additional Government Advocate appearing for respondents 1 to 3; and Sri. K.P. Bhuvan, learned counsel appearing for respondent No.4. 3. In the light of submission made by learned counsel appearing for the parties, though Sri. P.N. Manmohan, learned counsel appearing for the petitioner contended that the petitioner is claiming the right over the property through the original vendor, however, the mutation has been changed based on the registered Sale Deed dated 24th March, 1994 said to have been executed by S. Sridhar in favour of the respondent No.5 herein. In that view of the matter, taking into consideration the fact that the mutation of the subject land has been changed based on the registered instrument, I am of the view that, no interference be called for in this petition. It is open for the petitioner to establish his right over the subject land in a manner known to law before the competent Civil Court. It is made clear that the finding recorded by the revenue authorities in the impugned order as well as by this Court in the present petition would not come in the way of the of the petitioner to establish his right over the subject land before the competent Civil Court.
