Learned counsel for the petitioner apprise that the S.D.M. concerned has already initiated proceeding under Section 164 of BNSS 2023 and both the parties have given notice and are also participating in the proceeding and pending for consideration. So far as threat perception is concerned, he submits that still there is threat perception from the private respondents, however, since, the police station is nearby to his house, therefore, if he gets any threat from the private respondents he will immediate contact to the Police Station and the officials who are posted in the nearest Police Station also assure him that as and when if any situation of threat comes they will take immediate steps to protect the life and liberty of the petitioner. 5. Mr. Yogesh Sharma and Mr. Sandeep Tiwari, learned counsel have not disputed this fact that 164 BNSS proceedings have already been initiated by the concerned S.D.M. and the respondents are appearing before the authority. 6. Learned State counsel also admit that the proceedings are pending before the S.D.M. concerned under Section 164 of BNSS 2023. 7. In such view of the matter instant writ petition is disposed of finally with the direction to the concerned S.D.M. to give proper opportunity of hearing to the petitioner and the private respondents while dealing with the proceedings under Section 164 of BNSS 2023. Simultaneously, the S.H.O. of the nearest police station is also directed to be in contact with the petitioner so that in future if he gets any threat from any person including respondents he shall take immediate steps to protect the life and liberty of the petitioner. 8.
