Affidavit of service filed by the petitioner and the report submitted by the State are taken on record.
Learned counsel for the petitioner submits that pursuant to a work order issued by the Block Development Officer, Dhupguri on 8th February, 2022 in favour of the petitioner for repair and renovation of 9 primary schools for reopening of the schools at different sites under Gadhearkuthi Gram Panchayat within Dhupguri Development Block, the petitioner completed the work successfully and raised bills for the same. The amount of Rs. 9,23,354/-is still due. The petitioner seeks disbursal of the due amount. It appears from the report submitted by the State that admittedly the said work has been satisfactorily completed by the petitioner and a
2 prayer for release of fund has been sent to the District Authority by the Block Development Officer. In view of the above, the District Magistrate, Jalpaiguri, being the 6th respondent herein, is
directed to release the required fund in favour of the Block Development Officer, Dhupguri Development Block, being the 3rd respondent herein, within 8 weeks from the date of communication of this order. The 3rd respondent is directed to disburse the said amount in favour of the petitioner within two weeks of receipt of the same. The writ petition is disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J)
