The State of W.B. & Ors. Mr. Sayan Banerjee Mr. Gopal Roy …for the petitioner. Mr. Dipankar Sen Ms. Rajni Singh Dev ..for the State. Affidavit of service filed by the petitioners and instruction submitted by the State are taken on record. Pursuant to a work order issued in favour of the petitioners by the Pradhan, Charmarchi Gram Panchayat on 18th January, 2013 for construction of parking shed near Eco-tourism park at Part No.16/24 (ix) under Chamarchi Gram Panchayat, the petitioners completed the work satisfactorily and payment for the same to the tune of Rs.5,48,169/- was approved by the Block Development Officer, Dhupguri by a letter issued on 25th October, 2019. Learned counsel for the petitioners submits that the said amount is still due. The petitioners seek disbursal of the same. 2 Learned counsel for the State submits that no record of the said construction is found in the office of the Panchayat. The work order was issued in 2013 and approval of payment was made in 2019. No contemporaneous document has been produced by the State to demonstrate that the work was not completed in terms of the work order. In view of the fact that the bill raised by the petitioners to the tune of Rs.5,48,169/- is still pending despite completion of the work, the Pradhan, Chamarchi Gram Panchayat, being the 7th respondent herein is directed to disburse the entire due amount of Rs.5,48,169/- to the petitioners within eight weeks from the date of communication of this order subject to compliance with all requisite formalities by the petitioners. The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
