JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court, seeking the following prayers: <WHEREFORE, it is humbly prayed that this Hon'ble Court be pleased to quash the FIR in Crime No.250/2024 for offences punishable under Section 506, 504, 323, 324, 354 R/W 34 of IPC attached to Respondent No.1 Yeshwanthpura Police Station pending on the file of 31st Addl. CMM Court, Bengaluru, in the interest of Justice." 2. Heard Sri.Shafeer A A, learned counsel appearing for the petitioners, Sri.Channappa Erappa, learned HCGP appearing for respondent No.1, Sri.Suresha, learned counsel - 3 - HC-KAR NC: 2026:KHC:19762 CRL.P No. 10333 of 2024 appearing for respondent No.2 and have perused the material on record. 3. During the subsistence of the proceedings, the parties to the lis have entered into a settlement and have settled the dispute by filing Joint Memo drawing up certain terms of settlement. The Joint Memo filed by the parties to the lis reads as follows: <JOINT MEMO We, Latha N., W/o T Venkatesh Srinivasulu, Aged about 47 years, Resident at No.19/1,3rd Cross, Shivashankara Layout, Bagaluru Cross Main Road, Kattigenahalli Bus Stop, Yalahanka, Bengaluru-560064, Lavanya, D/o Late Jayaprakash, Aged about 23 years, Resident at No. 356, 8th Cross, 6th Main, MSR Nagara, Mathikere, Bengaluru- 560054 most respectfully submit this joint memo as follows: 1. We are Petitioner No.2 and Respondent No.2 respectively in. We know the facts of the case. Hence, we are filing this Joint Memo. 2. The petitioner No.2 is mother of the Petitioner No.1. She has been arraigned as accused No.2 and her son petitioner No.1 is arraigned as Accused No.1 in Crime No. 250/2024 for offences punishable under section 506, 323, 324, 354 R/W 34 of IPC registered by the Respondent No.1 Police. The Respondent No.1 Police after registration of this petition have subsequently filed Final Report against Petitioner No.2/Accused No.2 for offences punishable under section 506, 34, 504, 323, 354 R/W 34 IPC in CC No.32529/2024 pending on the file of Ld. XLIX ACJM, Bengaluru. 3. At the time of alleged commission of offence, the - 4 - HC-KAR NC: 2026:KHC:19762 CRL.P No. 10333 of 2024 Petitioner No.1/Accused No.1 was a minor. As such a SIR Report is alleged to have been submitted before the Juvenile Justice Board, Bengaluru. 4. It is submitted that the Respondent No.2 is the complainant before the Police in Crime No. Crime No. 250/2024 for offences punishable under section 506, 323, 324, 354 R/W 34 of IPC. 5. It is submitted that the mother of Petitioner No.2 one Smt. Lakshmamma has registered a complaint against Respondent No.2, in Crime No.253/2024 for offences punishable under section 341, 506, 323 of IPC before the Respondent No.1 Police. In this case the Respondent No.1 Police have submitted charge sheet against Ms.Lavanya in CC No. 25943/2024 for offense punishable under section 341, 506, 323 of IPC. 6. Due to the intervention of the elders and well-wishers both Petitioners, Petitioner No.1's mother Smt. Lakshmamma and Respondent No.2 have decided to withdraw cases filed against each other in C.C.No. 25943/24 & C.C.No.32529/2014 & JC No.13/26. 7. It is submitted that there are no other case or proceedings pending against each other before any other court of law, authority or forum other than the present petition. 8. In view of the above the Petitioners and the Respondent No.2 pray that this Hon'ble Court be pleased to quash the proceedings against the Petitioners in CC No.32529/2024 pending on the file of Ld. XLIX ACJM, Bengaluru for offences punishable under section 506, 34, 504, 323, 354 IPC in the interest of justice. WHEREFORE, it is humbly prayed that this Hon'ble Court be pleased to: a. quash the proceedings against Petitioner No.1 in SIR No.250/2024 and the consequential proceedings pending before the Juvenile Justice Board for offences punishable under section 506, 34, 504, 323, 354 IPC. b. quash the proceedings against Petitioner No.2 in CC No.32529/2024 pending on the file of Ld. XLIX ACJM, - 5 - HC-KAR NC: 2026:KHC:19762 CRL.P No. 10333 of 2024 Bengaluru for offences punishable under section 506, 34, 504, 323, 354 IPC in the interest of justice.= 4. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of the settlement arrived at between the parties notwithstanding the fact that the offence alleged is the one punishable under Section 323 of the IPC. For the reason that the dispute has been settled, I deem it appropriate to accept the Joint Memo and close the proceedings against the petitioners-accused. Hence, the following: O R D E R [I] Criminal Petition is disposed. [II] Proceedings in Crime No.250/2024 pending before the 31st Addl. CMM Court, Bengaluru, qua the petitioners, stand quashed.
