1.
Heard learned counsel for the parties.
2.
The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 302, 201, 120-B, 34 of the IPC and charge sheet submitted under section 302, 201, 120B, 34 of the IPC, in connection with S.T. No. 535 of 2024 arising out of Ichak P.S. Case No. 89 of 2024, pending in the court of Learned Additional Sessions Judge-I, Hazaribag.
3.
Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that the petitioner is not named in the F.I.R. He further submits that charges have already been framed against the petitioner on 24.03.2025 and there is no likelihood of his absconding or tampering with the evidence. He further submits that there are altogether 23 charge-sheet witnesses in this case, out of which only 11 witnesses have been examined till date, and the petitioner does not have any criminal antecedent. He lastly submits that the petitioner is in custody since 23.06.2024; as such, he may be released on bail.
4. Learned A.P.P opposes the prayer for bail of the petitioner and submits that there are direct allegations against the petitioner regarding murder of the deceased.
5. Having regard to the fact that already 18 witnesses have been examined and the learned trial court is seisin in the matter and considering the gravity of the charge, I am not inclined to enlarge this petitioner on bail.
6.
Accordingly, the instant application stands dismissed.
