Rakib (Partly Allowed) CRM (M) 1873 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kaliganj Police Station case no. 352 of 2021 dated 03.07.2021 under Sections 302/34 of the Indian Penal Code, 1860. And In the matter of : Swarajit Rajowar @ Sarajit Rajwar & Anr. ……Petitioners. Mr. Kusal Kumar Mukherjee Mr. Arijit Bose .....for the Petitioners. Mr. Amitabha Karmakar Ms. Shalu Gupta ……for the State. Learned advocate appearing for the petitioners submit that petitioners are in custody since 05.07.2025 and the accused who inflicted the vital blow has already been granted bail. Learned advocate appearing for the State opposes the prayer for bail and submits that the petitioners were evading the process of law for about four years. I have taken into account the period for which the petitioners were evading the process of law but from the evidence of the witness no.2, I find that the vital blow was struck by Sukdeb Rajowar, Archana and Arati. As such, prayer for bail of the petitioner no.2, namely, Archana Rajowar @ Archana Rajoyar is rejected at this stage. So far as the petitioner no.1, namely, Swarajit Rajowar @ Sarajit Rajwar is concerned, his prayer for bail is allowed. 2 Accordingly, the petitioner no.1, namely, Swarajit Rajowar @ Sarajit Rajwar shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Chief Judicial Magistrate, Krishnagar, Nadia. If on bail, the petitioner no.1 shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of district of Nadia without prior permission of the learned Trial Court. Thus, CRM (M) No. 1873 of 2026 is partly allowed. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
