1. The affidavit-of-service filed in Court today is taken record. 2. The present writ petition has been filed for a direction upon the respondents to process the petitioner’s pension papers who had superannuated on 30th September, 2025. 3. The municipality is represented. The learned advocate for the municipality has placed before this Court a communication dated 21st September, 2026 and would submit that in terms of the clarification sought for by the Director of Pension and Provident Fund and Group Insurance, the petitioner was required to submit his academic qualification, the same has not been done. Accordingly, the pension papers could not be processed. 4. Having heard the learned advocate for the municipality and noting from Mr. Sarkar, learned advocate for the petitioner that the petitioner had duly

complied with the requisition issued by the municipal authorities, however, since from the disclosure made by the municipality in Court, it would transpire that the certificate of diploma in engineering issued by the State Council for Engineering and Technical Education, Government of West Bengal has not been uploaded, for which the petitioner has been made responsible, I am of the view that the petitioner should immediately take steps and upload the necessary documents. The petitioner must also make over copies of the said documents to the respondent No. 5. Once, such documents are uploaded and/or made over to the respondent No. 5, the respondent No. 5 shall proceed and take all necessary steps to forward the same to respondent No. 6 for the said respondents in turn to take steps and issue appropriate orders so that the petitioner’s file can be processed and the PPO can be issued. 5.
The aforesaid direction is being issued having regard to the fact that there cannot be any dispute as regards the approval of the petitioner by the State, considering the documents appearing at page No. 22 and page No. 23 of the writ petition whereby the approval for creation of posts and approval for appointment of the petitioner was granted by the Joint Secretary to the Government of West Bengal as would corroborate from the letter dated 16th August, 2001 addressed to the Chairman, Kalna Municipality. In the peculiar facts, I direct the respondents to act in tandem and ensure that the PPO is issued in favour of the petitioner on an expeditious basis preferably within a period of six weeks from the date of communication of this order. 7. With the above observations and directions, the writ petition is disposed of. (Raja Basu Chowdhury, J.)
