JUSTICE ANANT RAMANATH HEGDE Digitally Signed by ANANT RAMNATH HEGDE - 3 - HC-KAR CNR: KAHC010066572026 NC: 2026:KHC:53187 CRL.P No. 1401 of 2026 ORAL ORDER Heard the learned counsel appearing for the petitioner. 2. The petition is filed to quash the Criminal Miscellaneous No.106/2021 registered Under Section 12 of the Protection of Women from Domestic Violence Act, 2005, which is pending before the Judicial Magistrate First class (Traffic Court-I), Mayo Hall, Bengaluru. 3. The prayer in the petition filed Under Section 12 of the Protection of Women from Domestic Violence Act, 2005, reads as under: "WHEREFORE, the Petitioner most humbly prays before this Hon'ble Court be pleased to pass an order prohibiting the respondent from a) Committing any act of Domestic Violence U/s.18(a) and (d) of the said Act. b) Dispossessing or in any other manner disturbing the possession of the petitioner from the share house hold shown in the above cause title of respondent, Digitally Signed by ANANT RAMNATH HEGDE - 4 - HC-KAR CNR: KAHC010066572026 NC: 2026:KHC:53187 CRL.P No. 1401 of 2026 and restraining him from prohibiting her say in the shored house hold. c) Other relief/s as this Hon'ble court deems fit upon the facts and circumstances of the above case, in the interest of justice and equity." 4. Learned counsel for the petitioner, referring to the interim application filed by the petitioner before the Trial Court, submits that in the application the respondent of this petition has stated that there is no violence inflicted on her. Thus, the learned counsel would contend that entire proceeding has to be quashed. 5. The prayer is totally misconceived. As already noticed above there is a prayer not to dispossess the petitioner, which she is allegedly sharing with the present petitioner, who is her husband. 6. It is also noticed that, the affidavit which is referred to by the learned counsel appearing for the Digitally Signed by ANANT RAMNATH HEGDE - 5 - HC-KAR CNR: KAHC010066572026 NC: 2026:KHC:53187 CRL.P No. 1401 of 2026 petitioner is only in respect of an interim prayer, i.e., not an affidavit filed in respect of the main prayer. 7. Thus, notwithstanding the statement that there is no violence inflicted, Prayer-B certainly requires adjudication. 8. Under the circumstances, the petition is dismissed. All contentions kept open.
