Affidavit of service filed by the petitioner and report submitted by the State are taken on record. The petitioner is aggrieved by the mode and manner of investigation undertaken by the Investigating Officer in connection with New Jalpaiguri Police Station Case no. 237 of 2026 dated 21st April, 2026 and seeks re-investigation by an independent agency.
Learned counsel for the State submits that charge sheet has been submitted upon completion of the investigation on 30th June, 2026. The writ petition has been filed on 8th September, 2026.

Learned counsel for the petitioner submits that the petitioner is not aware of submission of the charge sheet. Since charge sheet has been submitted, liberty is granted to the petitioner to file Narazi petition before the learned Magistrate in the event he is aggrieved with the investigation conducted by the Investigating Officer. In the event such application is filed, the learned Magistrate shall deal with the same in accordance with law as expeditiously as the business of the Court would permit. The writ petition is disposed of accordingly. There shall however be no order as costs. Since no affidavit is invited, the allegations contained in the petitioner are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
