Mr. Debabrata Dhar Mr. Ankan Mitra …for the petitioners. Ms. Supriya Singh Mr. Alok Sah ..for the State. Learned counsel for the petitioners submits that the land of the petitioners was vested in the State. The said vesting was quashed by this Court by an order passed on 3rd February, 1993 in CO 11435 (W) of 1990. In the meantime, patta in respect of the said land was granted to a number of persons. In a further writ petition being CO No.12631 (W) of 1993, this Court directed disposal of the proceeding for annulment of patta within a stipulated time frame. The petitioners submitted a representation seeking annulment of the patta granted by the authority and restoration of the land in their favour if the authority was not inclined to acquire the same. The representation is yet to be considered. The petitioners seek consideration of the same. 2 Learned counsel for the State submits that the representation be directed to be considered by the appropriate authority in accordance with law. In view of the above, the District Land and Land Reforms Officer, Cooch Behar, being the 4th respondent herein, is directed to consider and dispose of the representation submitted by the petitioners within four weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioners, in accordance with law. The decision taken by the authority shall be communicated to the petitioners within a week thereof. The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
