[2026:RJ-JP:12390] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 3050/2026 Ramesh Chand S/o Shankarlal, Aged About 32 Years, R/o Indra Colony, Chandsen, Tehsil Malpura, District Tonk, Rajasthan. ----Petitioner Versus The State of Rajasthan, through PP ----Respondent For Petitioner(s) : Mr. Mohit Balwada with Mr. Aditya Raj For Respondent(s) : Mr. Devi Singh, PP HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 24/03/2026 1. The petitioner has filed this bail application under Section 482 BNSS in connection with FIR No.145/2025 registered at Police Station-Diggi, District-Tonk for the offences under Section 303(2) of BNS, 2023 and Sections 4 and 21 of the Mines and Minerals (Development and Regulation) Act, 1957. 2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. He further submits that the only allegation against the petitioner is that he is the legal owner of the tractor involved in the case and no direct role was attributed to him. It is further submitted that no custodial interrogation of the petitioner is required. 4. Per contra, learned Public Prosecutor has vehemently opposed the bail application and submitted that allegations relates [2026:RJ-JP:12390] (2 of 2) [CRLMB-3050/2026] to illegal mining which has serious and economic ramifications. Petitioner is actively involved in the illegal transportation of minerals. It is therefore contended that the petitioner is not entitled for anticipatory bail. 5. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, especially that allegations relate to illegal mining which is a serious offence affecting public resources and environment. The material on record prima facie indicates the involvement of the petitioner in commission of the offence but without expressing any opinion on the merits/demerits of the case, I am not inclined to allow the present anticipatory bail application filed by the petitioner. 6. Hence, the present anticipatory bail application is hereby dismissed. (PRAMIL KUMAR MATHUR),J Arun/104
