Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents. 2. The petitioner by means of the present writ petition has prayed for the following main relief:- "(i) Issue a writ order or direction in the nature of certiorari quashing order communication dated 13.01.2026 by which petitioners application for issuance of caste certificate has been rejected (Annexure no.1). (ii) Issue a writ, order or direction in the nature of Mandamus directing the respondents' especially respondent no.5 to issue a fresh caste certificate on the basis of parent caste certificate and uploading certificate on website and further direct the respondent no.5 to issue provisional caste certificate accordance the parent caste. (iii) Issue a writ, order or direction in the nature of Mandamus directing the respondents' especially respondent no.3 to permit for admission till the disposal of present writ petition." 3. Challenging the aforesaid order, learned counsel for the petitioner has contended that impugned order is non-speaking and has been passed without application of mind which is in violation of principles of natural justice. It is contended that no reason has been assigned by the respondent-authority while rejecting the caste certificate of the petitioner. 4. Per contra, learned Standing Counsel submits that elaborate reasons have been given by the respondent no.5 while passing the impugned order. Accordingly, he submits that no interference is required with the impugned Versus Counsel for Petitioner(s) : Rajesh Kumar, Saurabh Kumar Pandey Counsel for Respondent(s) : C.S.C. Mayank Rawal .....Petitioner(s) State Of U.P. And 4 Others .....Respondent(s) order. 5. Be that as it may, the perusal of the impugned order reveals that the sole reason for rejection of the application of the petitioner for grant of caste certificate is 'Incomplete'. 6. Hence, it is evident that the application for grant of caste certificate has been rejected by the respondent no.5 by means of an unreasoned and non speaking order which shows complete non application of mind. Thus, the impugned order dated cannot be sustained in the eyes of law and is, accordingly, set aside. 7. The matter is remanded back to the respondent no.5-Tehsil Sadar, Etah through Tehsildar to pass a reasoned and speaking order on the application made by the petitioner for grant of caste certificate strictly in accordance with law within a period of one month from the date of production of certified copy of this order. 8.
