Complaining illegal construction by alleging that the petitioner’s neighbour being the respondent No. 4 herein has been carrying out illegal construction without leaving any statutory side space in terms of the West Bengal Municipal Act and the Rules, the instant writ petition has been filed. Though, a complaint was lodged before the municipal authorities, the municipal authorities are yet to take any steps. 3. Mr. Mukherjee, learned advocate appears for the State. 4. Having heard the learned advocates appearing for the respective parties and though the private respondent and municipality remain unrepresented, I am of the view that the instant writ petition can be disposed of by directing the municipality to take a decision on the petitioner’s complaint in accordance with law by passing a reasoned order, upon giving an opportunity of hearing to the petitioner and the respondent No. 4. WPA 24168 of 2026 2 5. It is expected that the decision in this regard shall be taken within a period of twelve weeks from the date of communication of this order. 6. Since no affidavit-in-opposition has been called for, the allegations made in the writ petition are deemed not to have been admitted by the respondents. 7.
