Kadapa District, basing on vague allegations as arbitrary, illegal, colorable exercise of power, contrary to the provisions of the Andhra Pradesh State Targeted Public Distribution System (Control) Order, 2018 and also the well settled legal principles apart from being violative of the fundamental rights guaranteed to me under Articles 14, 19 and 21 of the Constitution of India and consequently set aside the suspension proceedings, in Ref.No.F/1394/2025, dated 01.12.2025 and pass such IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased may be pleased to direct the respondent No.4 to allot the essential commodities in my favour for the Fair Price Shop No.1131123, Rama Krishna Nagar, Kadapa Town and Mandal, Y.S.R. Kadapa District by suspending the suspension proceedings in Ref.No.F/1394/2025, dated 01.12.2025 pending disposal of the above Writ Petition and pass such Counsel for the Petitioner: 1. V R REDDY KOVVURI Counsel for the Respondent(S): 1. GP FOR CIVIL SUPPLIES The Court made the following order: Heard Sri D. Vigneswar Reddy, learned counsel representing Sri V.R. Reddy Kovvuri, learned counsel for the petitioner and Sri Vineeth Appasani, learned Assistant Government Pleader for Civil Supplies, for respondents 1 to 5. 2. The notice in respect of respondent No.6 is dispensed with since no adverse order affecting her rights or interests is passed. 3. The petitioner was appointed as a Fair Price Shop Dealer in respect of F.P.Shop No.1131123, Rama Krishna Nagar, Kadapa Town and Mandal, Y.S.R. Kadapa District, in the year, 2019. Respondent No. 4, Tahsildar, conducted an inspection and submitted a report, based on which respondent No.3, by proceedings Ref.No.F/1394/2025, dated 01.12.2025, Ex.P1 suspended the authorisation of the petitioner, pending the enquiry under Clause 8 (4) (1) of the Andhra Pradesh Targeted Public Distribution System (Control) Order, 2018 (for short, ‘the Control Order, 2018’). Thereafter, respondent No.6 was appointed as a temporary dealer for the smooth distribution of the essential commodities. Challenging the suspension proceedings issued by respondent No.3, the above writ petition is filed. 4. Learned counsel for the petitioner would submit that the enquiry was not completed by respondent No.3 within the time prescribed as per clause 8(4) of the Control Order, 2018. Hence, the authorisation of the petitioner may be restored. 5. Learned Assistant Government Pleader, on the other hand, submitted that since respondent No.6 was appointed as a temporary dealer, no adverse order can be passed without giving her an opportunity. 6. In reply, the learned counsel for the petitioner would urge that respondent No.3 complete the enquiry within the time stipulated. 7. Learned Assistant Government Pleader would fairly submit that respondent No.3 will complete the enquiry within four weeks. 8. Given the above submission and the facts and circumstances of the case, without touching the merits of the matter, this writ petition is disposed of at the admission stage with the consent of learned counsel on either side directing respondent No.3 to complete the enquiry pursuant to Ex.P1, by following the procedure under Clause 8(4) of the Control Order, 2018 and also the circular instructions issued vide CCS.Ref.No.PDS.II(1)/307/2025, dated 05.12.2025, within four weeks from today. The petitioner shall cooperate with the enquiry. If respondent No.3 fails to complete the enquiry within four weeks from today, the impugned proceedings, Ex. P1, shall stand suspended without reference to any further order, and in such an event, respondent no.3 shall restore the authorisation of the petitioner in respect of F.P.Shop No.1131123, Rama Krishna Nagar, Kadapa Town and Mandal, Y.S.R. Kadapa District. There shall be no order as to costs.
