Mr. Dyutiman Banerjee Mr. Debjit Dutta ….for the petitioners Mr. Sudipta Bhattacharyya Mr. Lokesh Singh …for the State respondents 1) Affidavit of service filed on behalf of petitioners is taken on record. 2) Alleging illegal encroachment upon land of petitioners by private respondents present writ petition has been filed seeking direction upon concerned police authorities to take steps which would preserve right of petitioners over land in question. 3) Learned advocate representing State respondents has filed a communication dated 15th September, 2026 of Inspector-in-Charge, Narendrapur Police Station, Baruipur Police District and same is taken on record. Copy of said communication is made over to learned advocate representing petitioners. 4) It is disclosed in communication dated 15th September, 2026 that petitioners have approached the 2 learned Executive Magistrate, Baruipur, South 24 Parganas in a proceeding under Section 163(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and in connection therewith enquiry was made by concerned police authorities. From said communication it is not found that FIR was registered based on complaint of petitioners. 5) If petitioners find that their right over land in question is being denied by private respondents by encroaching same, in that event petitioners shall be at liberty to approach appropriate forum in pursuit of remedy. 6) It is also made clear that learned Executive Magistrate, Baruipur, South 24 Parganas shall be at liberty to proceed with the matter in accordance with law without being influenced by order of this Court. 7) Concerned police authorities are directed to maintain peace and tranquility at the locale and to see that no untoward incident takes place. 8) Writ petition is disposed of. 9) Parties to act on server copy of this order duly downloaded from the official website of this Court.
