Complaining illegal construction and/or deviation from the sanctioned building plan at premises No. 115/3, Brindaban Mallick Lane Howrah, the instant writ petition has been filed. 2. Having heard the learned advocates appearing for the respective parties including the learned advocate appearing for the municipality and respondent Nos. 7,8,9,10,12 and 14 as also the advocate for the State that there is a sanctioned building plan issued by the municipal authorities for construction of a G+2 storied building. Though, the learned advocate for the municipality would submit that the construction is yet to be completed and as such the writ petition is pre-mature, I, however, of the view that the municipal authorities at all stages of the construction, is duty bound to ensure that the construction confirms to the sanctioned building plan. Accordingly, let an inspection be carried out by the municipal authorities WPA 23981 of 2026 2 for the time being , the petitioner may not be invited to such inspection though the report thereof must be circulated if on the basis of the inspection being carried out by the municipality in presence of the State and the private respondents, the municipality is of the view that any illegal construction or any deviation shall take steps, immediately stop work notice shall be issued and the same shall be communicated to the petitioner whereupon a proceeding shall be initiated to deal with the same. 3.
