Affidavit of service filed by the petitioner is taken on record. On prayer of the petitioner, liberty is granted to add the Sub Divisional Officer, Contai, Purba Medinipur as respondent no. 10 in the writ petition. Since the State is represented, service of notice upon the added respondent is dispensed with. The private respondent is not represented despite service.
Learned counsel for the petitioner submits that the petitioner was provisionally appointed as a pump operator at Paldhui Kanpur Zone (PHE –II) under PHE V. The petitioner was restrained from operating the pump by some unknown miscreants for which the machine became non functional. The said fact was reported by the Assistant Engineer, Haldia Electrical Sub-Division, Public Health Engineering Department to the Sub-Divisional Officer, Contai Sub Division by a letter issued on 2nd September, 2026. The
2 petitioner seeks restoration of the earlier condition so that he is able to continue his work as a pump operator.
Learned counsel for the State submits that upon receipt of the letters from the assistant engineer as well as the petitioner, the Sub Divisional Officer has taken necessary steps. Complaint has been lodged before the police authority and operation of the pump has been restored.
Learned counsel for the petitioner denies such fact. In view of the fact that the petitioner, despite being engaged as pump operator, is unable to operate the pump, thereby causing hindrance to smooth water supply in the area, the Sub Divisional Officer Contai, Purba Medinipur being the 10th respondent herein, is directed to take necessary steps in this regard and ensure operation of the pumps within two weeks from the date of communication of this order. The writ petition is disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
