In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Chhatna Police Station case no. 02 of 2025 dated 08.01.2025 under Sections 316(2)/318(2)/318(4)/338/336(3)/339/340(2)/61(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023 adding Sections 111(3)/111(4) of the Bharatiya Nyaya Sanhita, 2023.
And In the matter of : Gouri Shankar Baksi @ Bakshi
……Petitioner. Mr. Suman Das Adhikary
.....for the Petitioner. Mr. Subhabrata Chowdhury Mr. Chandra Gupta Kamal
……for the State.
Learned advocate appearing for the petitioner prays for bail on the ground that the other accused persons have been released on bail. Petitioner is in custody for about one year eight months. The order dated 10.06.2026 passed by the learned Additional Sessions Judge, 1st Court, Bankura reflects that there is total non- cooperation from the side of the accused in respect of the progress of the trial of the case. Having considered the same, I am of the opinion that petitioner would renew his prayer for bail after the evidence of witnesses are over. Accordingly, CRM (M) 1841 of 2026 is rejected at this stage. Memo of evidence submitted by the State be kept with the record.
2 All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
