A. 840 22.09.2026 Court No.6 BP C.O. 393 of 2026 Prabhuram Das Adhikari & Ors. -versus- Sri Pradip Kumar Gucchait Mr. Pritam Choudhury Mr. Safik Dewan Mr. Tamal Taru Panda Mr. Sourav Mondal ..for the petitioners This application under Article 227 of the Constitution of India is at the instance of the defendants praying for a direction upon the learned Civil Judge (Junior Division), 1st Court at Contai, Purba Medinipur to dispose of the injunction application filed in Title Suit No. 1 of 2021 and the Miscellaneous Appeal No. 30 of 2022 pending before the learned Civil Judge (Senior Division), 1st Court at Contai, Purba Medinipur expeditiously. The learned advocate appearing for the petitioners submits that the learned trial judge refused to pass an ad interim order of injunction and being aggrieved by such order the opposite party preferred a miscellaneous appeal being No. 30 of 2022 which is pending before the Civil Judge (Senior Division), 1st Court at Contai, Purba Medinipur. He further submits that the said miscellaneous appeal is otherwise ready for hearing. He further submits that the injunction application filed in Title Suit No.1 of 2021 is also ready for hearing and the 2 next date for hearing of such application is fixed on 28th September, 2026. In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties. However, the learned advocate appearing for the petitioners shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing them before the learned trial judge. In the light of the submissions made by the learned advocate for the petitioners, C.O. 393 of 2026 stands disposed of with the following directions; 1. The learned Civil Judge (Junior Division), 1st Court at Contai, Purba Medinipur is requested to take up the hearing of the injunction application filed in Title Suit No.1 of 2021 on the next date fixed, if the same is otherwise ready for hearing and make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties. 2. The learned Civil Judge (Senior Division), 1st Court at Contai, Purba Medinipur is requested to dispose of the Miscellaneous Appeal No. 30 of 2022 as expeditiously as possible without granting any unnecessary adjournments to either of the parties. 3 There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities. (Hiranmay Bhattacharyya, J.)
