The petitioner has filed this writ petition seeking following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to direct the respondents to pay the petitioners the revised consolidated remuneration of Rs. 23,350/- per month on the post of Data Entry Operator in terms of the order dated 02.08.2023 (Annexure P/4) issued by the Finance Department with effect from the year 2023. 10.2 That, the Hon'ble Court may kindly be pleased to direct the respondents to pay all consequential arrears to the petitioners for the period from 2023 onwards, being the difference between the amount actually paid and the revised pay of Rs. 23,350 per month. 10.3 That, this Hon’ble Court may graciously be pleased to pass such further orders or directions as may be deemed fit and proper in the facts and circumstances of the case.” 2. Learned counsel for the Respondents No. 4 to 6 raises an objection with regard to maintainability of the writ petition on the ground that petitioner is an employee of the Respondents/Cooperative Society and therefore, the petitioner is having the alternate efficacious remedy of filing a suit under Section 55 (2) of the Chhattisgarh Cooperative Societies Act, 1960. 3 3. After arguing for sometime, learned counsel for the petitioner submits that he may be permitted to withdraw this writ petition at this stage with liberty to avail the other remedy available under the law. 4. On due consideration of the submission of counsel for the respective parties, this writ petition is dismissed as withdrawn at this stage, reserving liberty with the petitioner to avail the alternate remedy available under law. 5.
