Ms. Shrestha Datta …for the Respondent Nos.2-4. 1. Leave is granted to the petitioner to file the supplementary affidavit. 2. The petitioner, by filing this writ petition, inter alia, sought for the following reliefs:-
“A writ in the nature of Mandamus commanding the concerned respondents and each and every men, agent of them to take steps for registration of Lease deed of the plot under the Registration Act in respect of the land/plot No.LIG/7211 measuring 21.00 sq. mt. in favour of the petitioner within Sarsuna Housing Scheme – I, Behala.”
3. Pursuant to an application made by the petitioner, a house bearing no.72/1 (LIG type) measuring about 27.5 sq.mt. of plinth area built on a plot of 50 sq.mt. at Sarsuna Housing Estate Phase-I was allotted in favour of one Bablu Bandopadhyay by
2 the West Bengal Housing Board. A lease deed dated 27th May, 1986 was executed in this regard between the said Bablu Bandopadhyay and the said Board. The petitioner purchased the said house from the said Bablu Bandopadhyay on 30th May, 1988, as it appears from Page 4 of the Supplementary Affidavit, filed by the petitioner. 4. The petitioner, thereafter, requested the Assistant Housing Commissioner-I of the said Board to allot the adjacent vacant land adjacent to the house. Such prayer was considered and the said Housing Board by a Memo dated 3rd September, 2002 provisionally allotted a plot of land, measuring about 21 sq.mt., [hereafter ‘the said plot of land’] for a lease hold term of 999 years subject to payment of Rs.13,025/-. The petitioner duly paid Rs.13,025/- on 9th September, 2002. Thereafter, the petitioner requested the said Board to take necessary steps for registration of the lease deed in connection with the said plot of land. 5. The petitioner, by filing this writ petition, has challenged the inaction on the part of the respondent Board in not taking steps for registration in connection with the said plot of land. 6. In view of the above, the petitioner is directed to make a fresh representation to the respondent no.2 within a period of four weeks from date.

7. Respondent no.2 is directed to decide such representation after extending an opportunity of hearing to the petitioner and dispose of the same by passing a reasoned order. 8. The respondent no.2 is further directed to take all consequential steps with regard to the prayer of the petitioner for registration of the lease deed in connection with the said plot of land within a period of three months from the date of such decision. 9. Accordingly, the writ petition stands disposed of. 10. However, there shall be no order as to costs. 11. Urgent Photostat certified copy of this order, if applied for, be given to the parties on usual undertaking. (Arjun Ray Mukherjee, J.)
