Baruah, learned APP for the State. This is an application filed under Section 483 of the BNSS, 2023, seeking bail on behalf of the petitioner, namely, Akijul Hoque, who has been in custody Page No.# 2/2 since 17.02.2026 in connection with Sapatgram P.S. Case No. 16/2026, registered under Sections 21(a)/22(b)/29 of the NDPS Act, 1985. The Case Diary, as called for, has been received. The allegation against the present petitioner is that an intermediate quantity of different types of narcotic drugs, namely Nitrazepam tablets, Tramadol HCl and Acetaminophen capsules, and a powder-like substance suspected to be brown sugar, were recovered from the premises of the accused/petitioner. It is submitted that the FSL report is yet to be collected, though the remaining part of the investigation is already over. The learned APP submits that he opposes the prayer for bail on the ground that contraband was recovered from the premises of the petitioner. Having regard to the period of detention of 48 days, and considering the submission of the learned counsel that the petitioner is a first-time offender, this Court is of the view that further detention of the petitioner may not be necessary. Accordingly, the prayer for bail is allowed. The petitioner is directed to be released on bail upon furnishing a bail bond of Rs. 50,000/- with two sureties of the like amount, subject to the condition that he shall not directly or indirectly influence the witnesses or tamper with the evidence.
