JUSTICE WASIM SADIQ NARGAL, JUDGE ORDER 30.01.2026 During the course of arguments, the issue of maintainability of the instant petition was raised, as the challenge pertains to the order dated 16.10.2025, passed by learned Railway Magistrate in an execution petition, whereby the salary of the petitioner has been ordered to be attached at the rate of Rs. 30,000/- per month pursuant to an execution petition arising out of the National Lok Adalat Award dated 17.02.2024. When confronted with the maintainability of the instant petition, learned counsel for the petitioner seeks withdrawal of the instant petition with liberty to seek appropriate remedy under law. His statement is taken on record. In view of the statement made by learned counsel for the petitioner, the instant petition is dismissed as withdrawn with liberty as prayed for.
