Learned advocate, Ms. Banerjee and learned advocate for the alleged contemnor, Principal Secretary, Department of Urban Development & Municipal Affairs has submitted that the direction upon the alleged contemnor no.2 has been complied with from the part of the Principal 2 Secretary, Finance Department, Government of West Bengal. 4. They have filed the approval letter dated 26.09.2026 and sanction order for grant-in-aid in cash. 5. Learned advocate for the petitioner submits that although the order has been complied with from the side of the alleged contemnor nos.1 and 2, the Municipal authority has not yet released the fund. 6. Learned advocate for the Municipality, alleged contemnor no.4(a) has submitted that there are certain CID proceedings over the matter, that is why, there are some problems in releasing the fund in favour of the petitioner. 7. As per the submission of the learned advocate, the erstwhile alleged contemnor no.4, Mr. Indrajit Dhar has resigned from the office. Mr. Debasish Sarkar, erstwhile Executive Officer, Murshidabad Municipality is present. Alleged contemnor no.4(a), Puja Meena, Administrator, Murshidabad Municipality is personally present. 8. It appears from the record that this matter is pending since 2019 and it further appears that the Finance Department of Government of West Bengal has already approved and sanctioned grant-in-aid for the purpose of releasing the 3 amount in favour of the petitioner to the Municipal authority. 9. Therefore, I find that there would be no problem if the funds are released in favour of the petitioner, subject to condition that if the CID proceeding goes against him, he shall refund back the sum to the concerned authority. 10. Mr. Jahan has sought for ten (10) days’ time to comply with the aforesaid order. 11. In view of such submission, let the contempt application WPCRC 228 of 2026 be disposed of. 12. Personal appearance of all the concerned officers is hereby dispensed with. Interim Order, if any, stands vacated. 13. Connected application, if any, also stands disposed of. (Apurba Sinha Ray, J.)
