THIS PETITION COMING ON FOR ORDERS THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused in S.C.No.41/2026 pending before the Court of LXXI Additional City Civil and Sessions Judge, Bengaluru, arising out of Crime No.543/2025 registered by Peenya Police Station, Bengaluru, for the offences punishable under Sections 85 and 103(1), of Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as BNS, 2023), is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.543/2025 was registered by the Peenya Police Station, Bengaluru, for the offence - 3 - HC-KAR CNR: KAHC010420642026 NC: 2026:KHC:53992 CRL.P No. 8906 of 2026 punishable under Sections 85 and 109 of BNS, 2023, against the petitioner herein, based on the first information received on 25.9.2025 from Veerasangappa, son of Sangappa Thuppadh. During the course of investigation of the said case, petitioner herein was arrested on 25.09.2025 and was remanded to the judicial custody. After completing the investigation, charge sheet is filed for the aforesaid offences. His bail application filed before the jurisdictional Sessions Court was rejected, therefore he is before this court. 4. The records in the present case would reveal that the deceased Preethi Singh was the wife of the petitioner. The petitioner and Preethi Singh both hail from Bihar State. They loved each other and got married about 8 years prior to the registration of the FIR in the present case. From the wedlock, they have two children aged about 6 years and 3 years, respectively. It is alleged that the petitioner was ill treating his wife Preethi Singh on petty issues. - 4 - HC-KAR CNR: KAHC010420642026 NC: 2026:KHC:53992 CRL.P No. 8906 of 2026 5. On 24.9.2025, petitioner had not gone for work and had stayed back at home with his children. Preethi Singh who had gone out for work, had returned home for lunch. The petitioner allegedly asked her to provide him a glass of drinking water, since Preethi Singh refused to provide him drinking water, for the reason that he had not gone to work and also quarreled with him, the petitioner who got enraged, allegedly assaulted on her head with a wooden chapathi roller. As a result, Preethi Singh suffered injuries. Immediately thereafter petitioner shifted her to hospital. 6. Based on the first information submitted by the neighbor, FIR was registered against the petitioner for the offences punishable under section 109 and 85 of BNS, 2023. It appears that Preethi Singh who was admitted in the hospital, subsequently died on 02.10.2025 and therefore, offence punishable under section 103 (1) of the BNS 2023 was invoked against the petitioner. - 5 - HC-KAR CNR: KAHC010420642026 NC: 2026:KHC:53992 CRL.P No. 8906 of 2026 7. Post mortem report of deceased Preethi Singh would go to show that, while she was undergoing treatment in the hospital, on 02.10.2025 she suddenly had suffered cardiac arrest and though ACLS protocol was followed, the patient could not be revived back and at about 8.10 p.m., on 02.10.2025, she was declared dead. Petitioner who has no other criminal antecedents is in custody for the last more than one year and he is required to take care of his two minor children aged about 6 years and 3 years, respectively. 8. It is not in dispute that the petitioner has no other criminal antecedents and he undertakes to co- operate before the trial court for expeditious disposal of the case. Under the circumstances, I am of the opinion that prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. Accordingly, the following: Accordingly, the following : - 6 - HC-KAR CNR: KAHC010420642026 NC: 2026:KHC:53992 CRL.P No. 8906 of 2026 O R D E R The Criminal Petition is allowed.
