2. Mr. Pradeep Lohani, learned AGA with Mr. Chitrarth Kandpal, learned Brief Holder, for the State of Uttarakhand.

In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant – Kadeem, who has been accused in Case Crime No.75 of 2026, under Sections 8/21 of the Narcotic Drugs and Psychotropic Substances Act, at Police Station Kotwali Gangnahar Roorkee, District Haridwar.

As per the case of the prosecution based on the FIR that FIR was lodged by the Complainant on 18.02.2026 alleging that while the Police was on patrolling duty, on the basis of suspicion on the Applicant who was riding motorcycle and on seeing the Police tried to escape, intercepted the Applicant and the Applicant tried to throw a packet and on inquired told that the same is smack, and on weighing the smack it came out to be 15.38 grams with packet and 14.81 grams without packet.

Learned counsel for the Applicant submits that the Applicant has falsely been implicated in the present matter, and there is a delay in lodging of the FIR. He further submits that the Applicant is languishing in jail since 19.02.2026.
6. Considering the overall facts and circumstances of the
case, the Applicant has made out a case for bail.
7. Accordingly, bail application is allowed. It is directed that the Applicant - Kadeem, who has been accused in Case Crime No.75 of 2026, under Sections 8/21 of the Narcotic Drugs and Psychotropic Substances Act, at Police Station Kotwali Gangnahar Roorkee, District Haridwar, be released on bail on furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the concerned court. The Applicant shall cooperate with the trial proceedings and shall not misuse the liberty granted to her.
