ORAL ORDER
Heard the learned counsel for the petitioner and the learned High Court Government Pleader appearing for respondent No.1.
2. The second respondent though served is not present before the Court.
3.
Learned counsel for the petitioner would submit that the complaint is filed by the second respondent against the petitioner alleging that the petitioner has behaved inappropriately. The further submission is that the petitioner is an employee and the second respondent is a Company.
4. It is contended that the petitioner intended to resign. However he was told that the relieving letter and experience certificate would not be given to him. It is urged that when the petitioner requested for the same, the same is not handed over and the false complaint is filed.
4. It is the contention in the complaint that the petitioner did not insist for the experience letter as he intended to do farming. Digitally Signed by ANANT RAMNATH HEGDE

5. Learned High Court Government Pleader opposes the petition on the ground that the matter requires investigation.
6. This Court has considered the contentions raised at the bar and perused the records.
7. From the contents of the complaint it appears that the allegation of trespass is prima facie not maintainable, as the petitioner is the employee of the Company. As far as, the charges relating to the offences under Sections 351(2) and 79 of the Bharatiya Nyaya Sanhita (BNS), 2023 are concerned, the Court is of the view that the contents of the complaint are not sufficient to attract the said provisions.
It appears that a minor incident, which has taken place in the office premises where the petitioner has requested for experience certificate and relieving letter is blown out of proportion. The Court is of the view that there is no need to investigate the matter.
8. Under the circumstances, the following order is passed: Digitally Signed by ANANT RAMNATH HEGDE
