Learned advocate appearing for the petitioner submits that pursuant to the petitioner’s pre-arrest bail being refused by the Hon’ble Supreme Court in Special Leave to Appeal (Crl.) No(s). 2244/2026 on 10.02.2026, petitioner surrendered on 22.07.2026 and is in custody for two months. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and produces a report prepared by Superintendent of Police, Special Task Force, West Bengal. Although the seizure in this case is of about 103 kgs. of Ganja, but so far as the evidence against the petitioner is concerned, the same relates to personal knowledge of two witnesses. There has been no recovery. The report which has been submitted by the investigating officer 2 of the case reflects that there are no CDRs or money trail involved in the present case. So far as the antecedents of the present petitioner are concerned, it has been found that petitioner was acquitted in the earlier case and there are no further cases pending against the petitioner either in the police station or with STF, West Bengal. Having considered the totality of the circumstances and quality of materials available against the petitioner, I am of the opinion that further detention of the present petitioner in connection with the instant case is unwarranted. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner viz., Tinku @ Pinku Barman @ Tinku Barman shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the NDPS Act, 2nd Court, Berhampore, Murshidabad. If on bail, the petitioner shall be physically present on each and every date before the learned Special Court and shall not leave the jurisdiction of the district of Murshidabad without prior permission of the learned Special Court. Report submitted by the STF, West Bengal as well as the investigating officer of the case be kept with the record. The application for bail, being CRM (NDPS) 1910 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. 3 Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
