Case No.226 of 2025 dated 15.05.2025 under Sections 303(1), 316(2), 317(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023. And In the matter of: Titon Biswas @ Titan Biswas ….Petitioner. Mr. Sagar Saha Mr. Imtiyaz Kabir Ms. Noyana Mukhopadhyay ….for the petitioner Ms. Manisha Sharma Ms. Ayana De ….for the State Report filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioner submits that the petitioner was the agent who had arranged for transport of goods through a vehicle. It was alleged that the goods were not delivered at the destination on time. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail and submits as follows. The truck was intercepted and the driver was arrested but the goods were not found there. However, as of now, apart from the statements of the co- accused, the driver, there is no other material available in the case diary against the petitioner. Considering the above, the other materials available in the case diary and the alleged role ascribed to the present petitioner, I do not think that custodial interrogation of the petitioner is required in this case and I am inclined to grant anticipatory bail to the petitioner. 2 In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further condition that the petitioner shall cooperate with investigation, shall not threaten or intimidate witnesses and shall meet the I.O. once a week till submission of report in final form. The application for anticipatory bail is, thus, allowed. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities. (Jay Sengupta, J.)
