The revisional application has been preferred challenging the order dated 30th November, 2024 passed by the learned Additional Sessions Judge, 1st Court, Malda in connection with Sessions Case No. 90 of 2023, arising out of English Bazar Police Station Case No. 685 of 2020 dated 16th August, 2020 for the commission of offences punishable under Sections 448/376/195(A)/506 of the Indian Penal Code, 1860, thereby rejecting the petition under Section 231(2) of the Code of Criminal Procedure filed on behalf of the accused person/petitioner, presently pending before the learned Additional Sessions Judge, 1st Court, Malda. 2 2. Vide the impugned order, the learned Additional Sessions Judge, 1st Court, Malda was pleased to close the cross-examination of the victim on the grounds therein. 3. As none appears for the State, Mr. Goutam Banerjee, learned advocate and empanelled counsel of the High Court at Calcutta Criminal Panel, present in Court, is appointed to represent the State in this case. Let his appointment be regularized by the appropriate authority. 4. The petitioner prays for one opportunity to cross-examine the victim. 5. Accordingly, in the interest of justice, the impugned order dated 30th November, 2024 passed by the learned Additional Sessions Judge, 1st Court, Malda in connection with Sessions Case No. 90 of 2023 is set aside, with a direction that the learned Trial Court shall grant an opportunity to the petitioner to cross-examine the victim and complete the same on the same day. After completion of evidence of the victim, the learned Trial Court shall proceed in accordance with law. 6. Considering the fact that today is the date fixed before the learned Trial Court, the learned counsel appearing for the petitioner is at liberty to communicate the order as dictated in the Court. 7. With the aforesaid direction, CRR 5254 of 2024 stands disposed of. 8. Connected application being CRAN 1 of 2025 also stands disposed of. 3 9. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court. 10. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance with all requisite formalities. (Shampa Dutt (Paul), J.)
