23-09-2026 Item No31 Subrata Bhattacharyya AR(C) IN THE HIGH COURT AT CALCUTTA Constitutional Writ Jurisdiction Appellate Side WPA No.15710 of 2025 Kalpita Moitra (Chakladar) -vs- The State of West Bengal & Ors. Mr. Sk. Imiaj Uddin …for the petitioner 1. The petitioner retired on May 31, 2018. Her PPO was issued on April 2, 2025. She prays for interest on account of delayed payment of her terminal dues. 2. From the documents annexed to the writ petition, it appears that the petitioner approached this Court seeking release of her terminal dues by filing a writ petition being no. WPA 21136 of 2022. The writ petition stood dismissed by a learned single Judge holding that as wrong fixation of pay was detected when the petitioner was in service, she would not be entitled to any immunity from recovery of any overdrawal amount. 3. The petitioner thereafter preferred an appeal before the Hon’ble Division Bench being FMA No.777 of 2023. The said appeal stood disposed of by the Hon’ble Division Bench on November 14, 2024. The PPO was thereafter issued on April 2, 2025. 4. It does not appear that there has been any intentional delay on the part of the authority in releasing the terminal dues of the petitioner. The issuance of PPO got delayed because of litigation pending before this Court. 5. In view of the above, the prayer of the petitioner seeking interest on account of delayed issuance of PPO and delayed payment of terminal dues cannot be accepted. 6. The writ petition fails and is hereby dismissed. 7. All parties are to act on the server copy of this order duly downloaded from the official website of this Court. 8. Certified server copy of this order, if applied for, shall be made available to the parties. [Amrita Sinha, J] 2
