1. Affidavit of service filed be kept with the record.
2. Heard the learned Counsels for both the parties.
3. The present revisional application has been filed for transfer of Act VIII Case No.95 of 2023 under Section 10 of the Guardians and Wards Act, 1890 from the court of learned District Judge at Chinsurah, Hooghly to the court of learned District Judge at Barasat, North 24 Parganas.
4. It is the case of the petitioners/wife that she resides with her two children at Bira Ballabpara, P.O. Bira Ballabpara, P.S. Ashokenagar, District-North 24 Parganas, Pin-743234. (child’s ordinary place of residence).
5. On the other hand the husband/opposite party is a resident of Noapara Sukanta Pally, P.O. Kanaipur, P.S. Uttarpara, Dist-Hooghly, Pin-712234 and has filed the case at Chinsurah.

6. The petitioners/wife now prays for transfer of the suit being Misc. case (ACT VIII) no. 95 of 2023 pending in the learned District Judge at Chinsurah, Hooghly to the Court of learned District Judge at Barasat, North 24 Parganas.
7. Considering the ordinary place of residence of the child and relying upon this Court’s judgments in CO 4128 of 2024, Shantilal Sharma v. Susant Vyas @ Sushanta Vyas & Ors., directs that Misc. case (ACT VIII) no. 95 of 2023 be withdrawn from the Court of learned District Judge at Chinsurah, Hooghly and transferred to the Court of learned District Judge at Barasat, North 24 Parganas.
8. The learned District Judge at Barasat, North 24 Parganas shall proceed with the suit in accordance with law with due notice upon both the parties.
9. Keeping in mind the case of the opposite party herein, the learned District Judge at Barasat, North 24 Parganas, shall be at liberty to permit the opposite party to appear virtually, if such prayer is made.
10. CO 182 of 2025 stands disposed of.
11. Parties to act on the server copy of this order.
12. Let a copy of this order be sent to the concerned Courts for immediate compliance.
