This application under Article 227 of the Constitution of India is at the instance of the decree-holder praying for a direction upon the learned Civil Judge (Junior Division), 1st Court, Alipore to dispose of the Misc. Case No. 118 of 2026, expeditiously. The learned advocate appearing for the petitioner submits that the eviction decree has been affirmed upto this Hon’ble Court and the eviction decree has been put into execution and the son of the judgment debtor has filed an application under Order 21 Rule 98 and 101 of the Code of Civil Procedure. He further submits that 3rd October, 2026 is fixed for hearing of the aforesaid application. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite party. However the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned advocate for the petitioner, this civil revision application is disposed of by requesting the learned Civil Judge (Junior Division), 1st Court, Alipore, to take up the hearing of the Misc. Case No. 118 of 2026 on the next date fixed and make an endeavour to dispose of the same as expeditiously as possible but preferably within a period of four months from
2 the next date fixed without granting any unnecessary adjournment to either of the parties. The learned trial judge shall make an endeavour to dispose of the Ejectment Execution Case No. 17 of 20223 as expeditiously as possible. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
