The petitioner has challenged the orders of the Controlling Authority and respective orders of the Appellate Authority and the certificates issued in respect of the respondents no. 6, 7 and 8. 2. Mr. Majumder, learned Senior Counsel appearing for the petitioners submits that they are ready to deposit the requisite amount for preferring an appeal and prays that the impugned orders and certificates be set aside and the appeals be heard on merit by the appellate authority. It is further submitted that they are ready and willing to deposit the amount with the learned Registrar General of the High Court as they apprehend, that as the Puja Vacation intervenes, the appeals will be disposed of and the amount will be released by the Controlling Authority causing prejudice to the petitioner, as they will not be in a position to approach the High Court. 3. Considering the submissions made by the parties and on perusal of the materials on record, as the writ application is not being heard on merit and also in the 2 interest of justice this court condones the fact that the petitioner should have preferred three separate writ applications, as the cause of action in respect of the three respondents are separate. 4. Accordingly, the writ application is disposed of with liberty granted to the petitioner, that they shall deposit the requisite amount with the Controlling Authority in respect of each of the respondents herein being respondents no. 6, 7 and 8 and on the deposit being made the orders passed by the appellate authority in respect of the said three respondents shall be quashed and set aside and pending hearing of the appeals the orders of the controlling authority and the certificate proceedings in respect of the three respondents, shall remain stayed. 5. It is further directed that the amount deposited with the controlling authority shall not be released for 45 days from the date of communication of the order of the appellate authority to the petitioner. 6. The writ application being WPA 8960 of 2025 stands disposed of. 7. There shall be no order as to costs. 8. Urgent Photostat certified copy of this order, if applied for, be given to the parties on an usual undertaking. (Shampa Dutt (Paul), J.)
