Learned advocate appearing for the petitioner submits that petitioner is innocent, although the petitioner was a panchayat member, but he was not in a position to take a decision in respect of either disbursements or the accountability in respect of the tenders or jobs which are being conducted in respect of the tenders issued by the Government. Learned Public Prosecutor appearing for the State, on the other hand, opposes the prayer for anticipatory bail and refers to the relevant documents relating to allotment of tender as well as disbursements which have been made and 2 the principal accusation being that the purpose for which the tender was called, the job at all was not done. Having considered that in some of the documents, the signature of the petitioner is appearing, I am of the opinion that at this stage it is not possible for this Court to hold in favour of the submissions advanced on behalf of the petitioner. As such, the prayer for anticipatory bail of the petitioner is rejected. The interim order, if any, is hereby vacated. The application for anticipatory bail, being CRM (A) 3279 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
