For the State Affidavit of service filed on behalf of the petitioner and the report submitted by the State are taken on record. The Panchayat and the private respondents are not represented despite service. Alleging unauthorised construction raised by the private respondents, the petitioner submitted a representation before the concerned authority which was not considered. The petitioner approached this Court in a writ petition being WPA 29223 of 2023 wherein by an order passed on 19th December, 2024 a co-ordinate Bench of this Court directed the Pradhan to consider and dispose of the representation submitted by the petitioner dated 20th December, 2023 within a stipulated time frame. The order was not complied with for which contempt application was filed. The contempt application was disposed of directing the concerned Pradhan to consider and dispose of the representation within four weeks from the date of the order. In compliance thereof, the Pradhan took up the issue for consideration and requested the Block Land and Land Reforms Officer to demarcate the plot in question upon consideration of the documents produced by the parties. The 2 said resolution was assailed before this Court by the petitioner in WPA 14943 of 2025. By an order passed on 4th November, 2025, this Court refused to interfere with the resolution since final decision was not taken by the Panchayat authority. The petitioner was granted liberty to challenge the final decision taken by the authority in the event he was aggrieved by the same. Learned counsel for the petitioner submits that final decision is still pending. In view of the fact that the Block Land and Land Reforms Officer was directed to take necessary steps for demarcation of the plot in question by a resolution dated 8th May, 2022 and no final decision has been taken by the Pradhan till date, the Pradhan, Uttar Mokamberia Gram Panchayat, being the 7th respondent herein, is directed to consider the report of the Block Land and Land Reforms Officer, the representation submitted by the petitioner in this regard on 3rd July, 2026 and other relevant documents and arrive at a reasoned decision upon granting reasonable opportunity of hearing to all concerned including the petitioner and the private respondents within four weeks from the date of communication of this order, in accordance with law. The decision taken by the authority shall be communicated to the parties within a week thereof. In the event the construction raised by the private respondents is found to be illegal/unauthorised, the concerned authority shall take necessary steps in accordance with law. The writ petition is disposed of. 3 There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
