1. The petitioner has filed the present writ application with the prayer for a direction upon the SIR Tribunal for disposal of the appeal filed by the petitioner. In the meantime the petitioner appeared in the competitive examination for getting admission in the post-graduate course of male nursing and he has cleared the said examination. Before counseling he has to submit the domicile certificate but the authorities are not providing the same as his name has been deleted from the voter list. 2. Learned counsel for the petitioner prays for a direction upon the Sub-Divisional Officer, Chanchal, Malda for grant of the domicile certificate before counseling for the post-graduate course of male nursing. 3. Learned counsel for the ECI submits that an order can be passed by directing upon the Appellate Tribunal for disposal of the appeal filed by the petitioner as early as
2 possible. She further submits that though the petitioner has prayed for a direction upon the Sub- Divisional Officer, Chanchal, Malda for grant of domicile certificate but the Sub-Divisional Officer, Chanchal, Malda has not been made party in the present writ application. 4. Considering the submission made by the learned counsel for the respective parties, the petitioner is granted leave to add the Sub-Divisional Officer, Chanchal, Malda as party respondent in the course of the day. 5. In view of the above, the Appellate Tribunal is requested to consider and dispose of the appeal preferred by the petitioner as early as possible, preferably within a period of two weeks from the date of receipt of this order. 6.
The Sub-Divisional Officer, Chanchal, Malda is directed to consider the request of the petitioner for issuance of the domicile certificate if the petitioner otherwise eligible for and if it is found that the petitioner is entitled to get the domicile certificate, the same be provided to the petitioner on or before September 29, 2026 with an undertaking by the petitioner that in case the petitioner fails to succeed in the appeal preferred before the Appellate Tribunal, the petitioner will surrender the domicile certificate before the concerned authorities within a week after the decision of the Appellate Tribunal. 7. It is further made clear that if the petitioner is entitled to get the domicile certificate, the authorities shall consider the request of the petitioner without taking into
3 consideration of deletion of the name of the petitioner from the voter list. 8. Accordingly, the instant writ petition stands disposed of. 9. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Krishna Rao, J.)
