None appears on behalf of the petitioner on call. No accommodation has either been sought for. Even on earlier occasion on 17.09.2026, none represented the petitioner. 2. This case pertains to the year 2023. 3. Considering the nature of prayer and long pendency of this case, this court prefers to decide the case on merits based on the materials available on record. 4. The petitioner being the wife of the opposite party no. 2 herein has filed this revisional application under Section 482 of the Criminal Procedure Code, 1973 (for short, ‘Cr.P.C.’) seeking expeditious disposal of the proceedings initiated under the provisions of Protection of Women from Domestic Violence Act, 2005 bearing Case no. 185 C of 2015 pending before the learned 2nd Judicial Magistrate, Malda. 5. The brief fact of the case is that the marriage between the petitioner and the opposite party no. 2 were solemnized as per Hindu Rites and Customs on 2 09.07.2012. At the time of marriage, the petitioner’s parent paid a sum of Rs. 2 lakhs to the opposite party no.2 along with around 30 Bhories Gold ornaments and furniture and electronic home appliances as demanded by the opposite parties. 6. After marriage, she started conjugal life with the opposite party no. 2 at Malda. From the beginning of her conjugal life, the opposite party nos. 2 and 3 started inflicting torture upon her physically and mentally. They continuously demanded money from her parents. The petitioner to buy peace on many occasions had to bring money from her parents but often she could not bring the money, then the torture has been increased day by day. 7. On 04.11.2014 the opposite parties also assaulted her with threat to kill and for that reason, the petitioner lodged a complaint before the office of English Bazar Women Police Station being English Bazar Women P.S. Case no. 79 of 2014 under Sections 498A/307/506/34 of IPC read with Sections 3 & 4 of Dowry Prohibition Act. She is now residing in her parental house upon taking shelter. When she is unable to maintain herself, she had compelled to file a proceeding under the provisions of Protection of Women from Domestic Violence Act, 2005 with an application for maintenance seeking monthly maintenance of Rs. 15,000/- per month right to 3 residence and return of her Stridhan articles before the learned Chief Judicial Magistrate, subsequently, the matter was transferred to the learned 2nd Judicial Magistrate at Malda on 17.04.2015 for trial. But, till date, no trial has yet been concluded. Although it was filed in the year 2015. She prays for expeditious disposal of the proceedings. 8. Having gone through the materials available on record as well as the prayer made by the petitioner, this court finds that the prayer for expeditious disposal of the case is simple and innocuous. Furthermore, there is no impediment to dispose of this revisional application directing the Trial Court to decide the said Case on its own merits. 9. Accordingly, CRR 2506 of 2023 is allowed and disposed of. 10. Consequently, the connected applications, if any, stand disposed of. 11. Trial court is directed to dispose of the case on its own merits as expeditiously as possible without granting unnecessary adjournment to the parties and arrive at a logical conclusion without being influenced by any of the observations, whatsoever, made in this order. 12. Interim order, if any, stands vacated. 13. Let a copy of this order be communicated to the learned court below forthwith. 4 14. All parties shall act in terms of the copy of this order downloaded from the official website of this court. 15.
