1. This present application has been filed seeking quashing of the proceedings in G.R. Case No. 2858 of 2023, pending before the learned Chief Judicial Magistrate, Barasat, North 24 Parganas,

arising out of FIR No. 197 of 2023 dated 11.10.2023, registered at Technocity Police Station, under Sections 143/342/352/506/34 of the Indian Penal Code, 1860. 2. The allegations brought by way of the first information report, inter alia, is to the effect that on 07.10.2023 at 9:30am, around 50 to 60 residents of Uniworld City had allegedly gathered in front of the facility office of Uniworld City Apartment Owners Association led by 12 accused persons which included the petitioners herein who had called the president of Uniworld City Apartment Owners Association namely Partha P. Chatterjee along with the other Board of Managers namely P.Ganguly, P.Kumar, D.Dattachowdhary, S. Bandyopadhyay, J.Banerjee, P. Nandy, S.Mukherjee, Dr M. Mukherjee, Dr. B.Gupta and B.Basu Roy Chowdhury outside the facility office and therafter started abusing them and threatening them that they would refuse to let them leave till they all hand over their resignation from the said Association. Fearing for their physical safety and being under duress, mental stress and trauma, they ended up signing their resignations. 3. The petitioners claim that the members of the association under the garb of running an apartment owner's association had been indulging in financial irregularities. 4. On 07.10.2023 at 9:30am, majority of the residents of Uniworld City had all gathered near the facility office of the association and

demanded that the existing board members step down immediately by handing their resignations. The entire incident has been recorded in the CCTV cameras installed in the society. There was a mass gathering of the residents of the society who raised protest against the Members of the Association among which the petitioners were also a party but out of all the other residents who were present there, the petitioners herein were handpicked by the Members of Association owing to the fact that they already had a vendetta against the petitioners herein and thus the
de facto complainant/opposite party no.2 being the ex-secretary of the association by suppressing the entire facts of the incident which occurred on 05.10.2023, had maliciously initiated this instant FIR, against 12 residents of Uniworld City which includes the petitioners herein. 5.

While the investigation was ongoing, the members of Uniworld Apartment Owners Association along with the opposite party no.2 had been constantly harassing the petitioners herein every now and then and intimidating them into submission in order to cover up their financial irregularities. The situation reached its zenith on 07.11.2023 when the ex-president of the Uniworld City Apartment Owners Association namely Partha Pratim Chatterjee, along with ex- secretary of the association Supriya Ghosh i.e. the opposite party no.2 herein along with other members of the association had visited

the residence of the petitioner no.2 herein to intimidate him and demanded him to come downstairs and to meet them in order to offer them an unconditional apology for having previously raised concerns about the financial irregularities arising out of conflict of interest in fundraising collection drive for the Durga Puja against the opposite party no.2 herein. They had taken the law into their own hands causing the petitioner no.2 to fear for his safety for which he had locked himself in his flat along with his family. The petitioner no.2 thus lodged an FIR being Technocity Police Station Case No. 02/2024 dated 04.01.2024 under sections 406/342/352/336/448/511/504/506/120B/34 of the Indian Penal Code, 1860 against 10 persons who were members of the association among which the opposite party no.2 is one of the co- accused persons. 6. The said case, in CRR 930 of 2025 has been quashed vide an order dated 31.08.2026 by a Co-ordinate Bench of this Court. 7. Upon completion of the investigation, the Investigating Agency submitted a charge-sheet in the said proceeding. 8. This Court, upon perusal of the charge-sheet and other materials available on record in connection with G.R. Case No.2858 of 2023, is of the view that the dispute is essentially one relating to the management and administration of the aforesaid association, namely, Uniworld City Welfare Association. There is no

incriminating material collected during the course of investigation by the Investigating Agency which would justify the continuance of the present criminal proceeding. 9. In view of the aforesaid, the continuation of the present criminal proceeding would serve no useful purpose and would be an abuse of the process of law. 10.
Thus, the proceedings in G.R. Case No. 2858 of 2023, pending before the learned Chief Judicial Magistrate, Barasat, North 24 Parganas, arising out of FIR No. 197 of 2023 dated 11.10.2023, registered at Technocity Police Station, under Sections 143/342/352/506/34 of the Indian Penal Code, 1860, is hereby quashed, in respect of the petitioners namely Harsh Kumar Jha @ Harsh Jha, Surya Narayan Bhattacharya @ Surya Narayan Bhattachrya, Sanjay Agarwal, Mamta Sarda, Kumar Kaish @ Kumar Kish @ Kumar Singh @ Saha, Siddharth Agarwal, Satarupa Roy, Rohit Singh, B.S. Kameshwar Rao, Sanjeev Sancheti, Kumar Pintu Saha and Anirban Roy Chowdhury @ Ray Chowdhury @ Anirban Roy. 11. CRR 4101 of 2024 with CRR 4099 of 2024 are also disposed of. 12. All connected Applications, if any, stand disposed of. 13. Interim order, if any, stands vacated. 14. Copy of this judgment be sent to the learned Trial Court for necessary compliance. 6
