1. The present writ petition has been filed seeking a direction to the respondent no.1 to demolish the unauthorised construction going on at WZ- 5, Ramgarh Colony, Basai Darapur, New Delhi. A direction is also sought against the respondent no.2/SHO to ensure immediate stoppage of construction. 2. It is stated that both the petitioner and respondent no.3 reside in the same premises. The petitioner lives in the rear right side portion of the subject property and the respondent no.3 occupies the left portion of the said property. 3. It is stated by the petitioner that the unauthorised construction has been carried out even during the period when GRAP (Graded Response This is a digitally signed order. Counsel for the respondent no.1/MCD submits that a demolition order in respect of the unauthorised construction going on in the aforesaid property has been passed on 5th January, 2026 and 15 days’ time has been given to the respondent no.3 to demolish the unauthorised construction, failing which action would be taken by the respondent no.1. 6.1. The aforesaid demolition order dated 5th January 2026 has been handed over in Court and is taken on record. 7. Further, a communication has also been sent to the respondent no.2/SHO on 19th December, 2025, directing them to ensure that no further construction takes place at the subject property. 8. The respondent no.2/SHO shall ensure that no further construction is carried out at the said property. 9. In terms of the aforesaid, the writ petition stands disposed of. 10. Pending application also stands disposed of.
